The Kano Court of Appeal has delayed a Federal High Court decision that nullified the primaries that produced Alex Otti and other Labour Party (LP) candidates in Abia State.
Justice Mbaba made the decision on Saturday, and he also approved Alex Otti’s attempt to appeal as an interested person.
The Federal High Court’s decision has been provisionally stayed pending the hearing and outcome of the appeal.
The Court of Appeal’s decision came in response to the Abia Governor-Elect’s plea for leave, in which he requested permission to appeal as an interested party against the judgment rendered by the Kano Division of the Federal High Court on May 18, 2023, in Suit No. FHC/KN/CS/107/2023.
Furthermore, the Appellate Court granted an order for stay and suspension of the lower court’s ruling given by Justice Yunusa J
This suspension will last until the appeal for which leave has been granted is heard and determined.
